These Terms of Service (“Terms”) are an agreement between you and CareLuxe Solutions LLC (“CareLuxe Solutions,” “we,” “us,” or “our”). They cover your use of our public website and of the MyCareLuxe Portal, the secure application we use for caregiver applications, onboarding, training, and account management. By using our website or signing in to the portal, you agree to these Terms. If you do not agree, please do not use them.

Who May Use Our Services

Anyone may browse our public website for general information. The MyCareLuxe Portal is available only to people we invite or create an account for — applicants, caregivers and other staff, and administrators. You must be at least 18 years old to create or use a portal account. You are responsible for keeping your sign-in details private and for activity that happens under your account. Tell us right away if you believe your account has been used without your permission.

Using the Portal Responsibly

When you use the portal, you agree not to:

• Share your login, or use an account that is not yours;
• Submit information you know to be false, or impersonate another person;
• Try to access data, records, or areas you are not authorized to see;
• Interfere with, disrupt, or attempt to break the security of the service; or
• Use the service for anything unlawful or against these Terms.

Electronic Records and Signatures

Parts of applying, onboarding, and training ask you to sign forms electronically. By signing electronically, you agree that your electronic signature is legally binding and has the same effect as a handwritten one, and that we may keep electronic records of what you signed. As explained in our Privacy Policy, we record signing details (such as the date, time, and method) so signed records can be verified later.

Not for Emergencies

Our website and portal are not for emergencies. If you or someone in your care is experiencing an emergency, call 911 or seek immediate medical help.

No Professional Advice

Information on our website and in the portal is for general and operational purposes. It is not medical, legal, or financial advice and should not replace guidance from a qualified professional or the care plan set for a specific client.

Our Brand and Content

Our website, the portal, and their content, software, and design belong to CareLuxe Solutions or our licensors. Use of our names and logos is covered by our Trademark Policy. You may not copy, resell, or reuse our content or software except as these Terms allow.

Service Availability and Changes

We work to keep our website and portal running, but we do not promise they will always be available or error-free, and we may add, change, or remove features over time. Website content may change and can become out of date.

Disclaimer of Warranties

This section is about use of the website and portal; it does not change the terms of any separate agreement for home care services.

Suspending or Ending Access

We may suspend or end portal access if an account is misused, if these Terms are broken, or when someone is no longer an applicant, employee, or authorized user. You may ask us to close your account at any time. Some records may be kept afterward as described in our Privacy Policy and as the law requires.

Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules. Any dispute relating to these Terms, our website, or the portal will be handled in the state or federal courts located in Pennsylvania.
